The advancement of information technology in today's digital era has brought significant influence across various sectors of life, including in the field of criminal acts. One of the crimes that frequently occurs is the dissemination of pornographic content through digital media, which even involves minors as perpetrators. This crime not only causes moral and psychological harm but also poses unique challenges in the legal proof process, especially when the perpetrator is underage.
This research aims to analyze the legal standing and evidentiary strength of electronic evidence in the form of screenshots in proving pornography crime cases, with a study on the Decision of the Blitar District Court Number 3/Pid.Sus-Anak/2025/Pn.Blt.
The method applied in this research is normative legal research, which focuses on the study of legal materials, including legislation, court decisions (jurisprudence), and legal doctrines related to digital evidence in criminal cases. The approaches used are the statutory approach and the case approach, to examine how legal provisions are applied by the panel of judges in criminal cases involving digital evidence.
Based on the results of the research, it was found that in rendering decisions in criminal cases involving minors as perpetrators, judges do not solely rely on digital evidence such as video recordings, electronic conversations, or other digital documents. Judges also consider the completeness of other evidence as regulated in the criminal procedural law, such as witness testimony, the defendant's statement, and documentary evidence. Furthermore, the panel of judges takes into account the personal circumstances of the perpetrator and social environmental factors. Although these considerations are sociological in nature, they play a role in strengthening the legal reasoning in the decision rendered.
Therefore, court decisions in criminal cases involving digital evidence are not solely repressive but also uphold a principle of justice that balances legal certainty and humanitarian values. This illustrates that although the criminal procedural law regulates the types and strength of evidence, in practice judges still carry out comprehensive legal interpretations to ensure that the decisions rendered fulfill not only legal-formal aspects but also substantive justice.
