KEABSAHAN PENGGUNAAN TANDA TANGAN ELEKTRONIK SEBAGAI ALAT BUKTI SURAT YANG SAH

ABSTRAK
Perkembangan teknologi informasi telah membawa perubahan signifikan dalam aktivitas masyarakat, termasuk penggunaan tanda tangan elektronik dalam perjanjian daring. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan konseptual, serta analisis deduktif terhadap bahan hukum primer, sekunder, dan non-hukum.
Hasil penelitian menunjukkan bahwa tanda tangan elektronik memiliki kedudukan sah sebagai alat bukti yang diatur dalam Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik (UU ITE) serta Peraturan Pemerintah Nomor 82 Tahun 2012. Dokumen elektronik yang ditandatangani secara elektronik memiliki kekuatan pembuktian yang setara dengan akta autentik, sepanjang memenuhi syarat yang ditetapkan undang-undang. Akibat hukum penggunaannya menimbulkan kepastian dan perlindungan hukum bagi para pihak, dengan tetap merujuk pada KUHPerdata sebagai lex generalis.
Tanda tangan elektronik memiliki kekuatan hukum yang sah dalam proses pembuktian perkara perdata di Indonesia. Oleh karena itu, penerapan regulasi terkait perlu diperketat agar memberikan kepastian hukum, sekaligus memastikan bahwa penggunaannya sejalan dengan asas-asas hukum perdata.

ABSTRACT
The development of information technology has brought significant changes to societal activities, including the use of electronic signatures in legal agreements. The research method used is normative juridical, with a regulatory and conceptual approach, as well as deductive analysis of primary, secondary, and non-legal legal materials.
The results of the study indicate that electronic signatures have legal standing as evidence as regulated in Law Number 11 of 2008 concerning Electronic Information and Transactions (ITE Law) and Government Regulation Number 82 of 2012. Electronically signed electronic documents have the same evidentiary force as authentic deeds, all of which meet the requirements stipulated by law. The legal consequences of their use create legal certainty and protection for the parties, while still referring to the Civil Code as the lex generalis.
Electronic signatures have legal force in the evidentiary process of civil cases in Indonesia. Therefore, the implementation of relevant regulations needs to be tightened to provide legal certainty while ensuring that their application is in line with the principles of civil law.
