Penelitian ini memiliki tujuan untuk mengetahui bagaimana perlindungan hukum anak dibawah umur dalam peralihan hak atas tanah karena pewarisan (studi putusan nomor: 22/Pdt.P/2024/PN Blt). Penelitian ini menggunakan penelitian yuridis empiris yang melibatkan studi tentang latar belakang, kondisi saat ini, dan interaksi lingkungan yang berkaitan dengan objek yang diteliti. Data primer sebagai dasar dipadukan dengan data sekunder yang relevan. Hasil dari penelitian ini ialah perlindungan hukum bagi anak dibawah umur dalam peralihan hak atas tanah karena pewarisan. yang harus ada penetapan perwalian dari Pengadilan Negeri Blitar. Sesuai pula dengan Pasal 330 KUHPerdata, Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan dan Undang-Undang Nomor 35 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 23 Tahun 2002 tentang Perlindungan Anak. Perwalian diperlukan untuk menjamin adanya hak perwalian atas harta anak, sehingga dapat melindungi dan mengelola harta anak tersebut. Dalam hal ini permohonan perwalian RWD untuk anaknya yang masih dibawah umur yaitu ANA dikabulkan oleh hakim. Perkara Perdata tersebut telah diperiksa melalui persidangan serta dinilai tidak bertentangan dengan hukum.

LEGAL PROTECTION OF MINORS IN THE TRANSFER OF LAND RIGHTS DUE TO INHERITANCE

This research aims to find out how legal protection is for minors when transferring land rights due to inheritance (study decision number: 22/Pdt.P/2024/PN Blt). This research uses empirical juridical research which involves the study of the background, current conditions and environmental interactions related to the object under study. Primary data as a basis is combined with relevant secondary data. The result of this research is legal protection for minors when transferring land rights due to inheritance. there must be a guardianship determination from the Blitar District Court. Also in accordance with Article 330 of the Civil Code, Law Number 1 of 1974 concerning Marriage and Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection. Guardianship is needed to guarantee the right of guardianship over the child's assets, so that they can protect and manage the child's assets. In this case, the judge granted RWD's application for guardianship for his underage child, namely ANA. This civil case has been examined through trial and is deemed not to be in conflict with the law.
